ICE has issued a statement establishing its procedural policy regarding international students enrolled in courses for the fall 2020 semester. It notes that nonimmigrant students and schools certified by the Student and Exchange Visitor Program (SEVP) should abide by SEVP guidance originally issued in March 2020. The above mentioned March 2020 guidance applies to nonimmigrant students who were actively enrolled at a U.S. school on March 9 and are otherwise comply...ing with the terms of their nonimmigrant status, whether from inside the U.S. or abroad. ICE further stated that SEVP will not issue a temporary final rule impacting nonimmigrant students for the fall school term. The most important takeaway from this determination is that In accordance with March 2020 guidance, nonimmigrant students in new or initial status after March 9 will NOT be able to enter the U.S. to enroll in a U.S. school as a nonimmigrant student for the fall term to pursue a full course of study that is 100 percent online. Additionally, designated school officials should not issue a Form I-20 to a nonimmigrant student in new or initial status who is outside of the U.S. and plans to take classes at an SEVP-certified educational institution fully online. This means that recently enrolled international students will not be allowed entry into the United States if their schools will operate entirely online this upcoming fall. Judge Paul Grimm of the U.S. District Court in Maryland ordered yesterday that the Department of Homeland Security must restore DACA. In his decision, Judge Grimm concluded that: ... The Court adjudges and declares that the DACA rescission and actions taken by Defendants to rescind the DACA policy are arbitrary and capricious... The rescission of the DACA policy is vacated, and the policy is restored to it’s pre-September 5, 2017 status. This means that USCIS must now start accepting applications for first time eligible DACA applicants. USCIS has yet to issue any statement in response to the above mentioned order. On Friday July 10, Trump spoke with José Díaz-Balart, a Telemundo journalist and television anchor. The interview included topics such as Venezuela, the murder of Army soldier Vanessa Guillén, the Supreme Court’s recent ruling regarding his financial records and an Executive Order which he announced the administration is currently working on for immigration policy changes in the United States. ... The said order would allegedly provide a pathway to citizenship for Dreamers, according to Trump. In the words of Trump himself: ...we put it in, and we’ll probably going to then be taking it out. We’re working on the legal complexities right now... He also mentioned during the interview, a merit-based bill. Beyond these statements, no further details about what other immigration aspects affected by the order were shared. Earlier today, the Coalition for the American Dream issued a letter urging Trump to leave DACA in place. (ICE), la agencia responsable del Programa de Estudiantes y Visitantes de Intercambio (SEVP), anunció ayer varias modificaciones al programa para el semestre del otoño 2020. Las modificaciones implementadas tienen un impacto drástico en los estudiantes y aquellos dentro de los Estados Unidos y/o en el extranjero deben mantenerse informados sobre estos cambios y otros posibles en el futuro. ... Las escuelas deben actualizar su información en el Sistema de Estudiantes y Visitantes de Intercambio (SEVIS) dentro de los 10 días posteriores al cambio si comienzan el semestre de otoño con clases presenciales, pero luego cambian sólo a clases en línea (online), o en caso de que un estudiante no inmigrante cambie sus selecciones de cursos y, como resultado, termina tomando una carga de cursos completamente en línea. Los estudiantes no inmigrantes dentro de los Estados Unidos no pueden tomar un curso completo de estudio a través de clases en línea solamente. Si los estudiantes se encuentran en esta situación, deben abandonar el país o tomar medidas alternativas para mantener su estatus de no inmigrante, como una carga reducida del curso, transferirse a una escuela presencial u obtener un permiso médico apropiado.
