Happy 2021! Our opening #misinfomonday is the false assumption that we left politics and real estate issues/legislation behind in 2020, because NOPE! Tomorrow’s Georgia primary will impact federal aid to states and policy for the next two years. And here in NYC we have the City Council and Mayoral races kicking off in full force. With about 30 people running for mayor and all of them talking about housing, this is going to be an interesting year for real estate. The fall’s ...veto-proof liberal majority is already busy in Albany crafting legislation some of which I like and some of which I think is misinformed that will impact development, evictions, taxation, zoning, and rental laws. But the landlord lobby has its eye on SCOTUS to overturn any rent laws that do pass (and the 2019 HSTPA), because that is the best use of everyone’s time, money, and energy. I have absolutely no predictions for you, but I’ll be following along and separating rumor from hollow campaign promise from reality (as much as some woman on the internet can). Don’t listen to clickbait, and don’t forget how many agents are incompetent, racist, and believe in shit like flat earth and QAnon, so just because someone in the industry says it doesn’t mean it’s true. Today’s #misinfomonday (accompanied by a photo from very early lockdown) is about month-to-month tenancy and harassment from landlords. If you signed an original lease but do not have a current renewal lease, continued paying, and your landlord continued to accept payments, you are considered a month-to-month tenant. Either party can cancel the lease with notice (in most cases 30+ days). While that arrangement has long been a tradeoff for both parties, the recent balan...ce of power switch means some landlords are threatening their tenants choosing to leave. But you can’t be sued for breaking a lease when there is no lease. Your landlord cannot sue you for money you don’t owe. Look, it sucks to hear a tenant will be leaving right now. But the response is not to threaten the person with baseless litigation. If they show up to bother you in person, call the police. They CANNOT evict you themselves, no matter what. And guys, ALWAYS call me if you have something like this happening to you.
