On April 7, 2020, Governor Cuomo signed the latest Executive Order which now allows for remote witnessing of legal documents via audio-video technology, with certain conditions having to be met. As of now, the Governor’s Order allows for remote witnessing until May 7, 2020. The Executive Order specifically references New York State’s statutes governing the execution of Wills, Powers of Attorney and Health Care Proxies, three important documents that most, if not all, individ...uals should have as part of their estate plan. This latest Executive Order along with the Governor’s prior Executive Order allowing for remote notarization of documents are critical laws for Elder Law and estate planning attorneys who have been working diligently to implement new strategies for their clients to be able to sign important legal documents while complying with the laws of New York State. We at APFW Law already have plans in place to safely and effectively serve our clients within the legal boundaries set by our state while also keeping the health of our team and clients our first priority.
