We are pleased by NYS Supreme Court's decision, and we commend all of the difficult and thoughtful work that has gone into studying the Continental Commons property and the Fishkill Supply Depot, which played a significant role in the American Revolutionary War. This week the New York State Supreme Court ruled that there was a tremendous amount of archaeological evidence that the Continental Commons project would not adversely impact the historic nature of the Fishkill Supply Depot. The Court even pointed out that there was ample evidence in the record that the foundation on the property was not from the American Revolution nor was the single grave that was examined. The Friends of the Fishkill Supply Depot filed litigation arguing that the Fishkill Planning Board did not take a hard look at the Continental Commons proposal. The FOFSD also made five other arguments in their litigation with hopes of overturning the approvals. The judge ruled against the FOFSD on all grounds. In the decision the court concluded the following: 1. That the NYS SEQR review process considered all historic and environmental issues; 2. Over the four year SEQR rev...iew, a substantial amount of information was presented to the Fishkill Planning Board about whether the proposed project would have an impact on the historic integrity of the site from Continental Commons representatives, from the community, New York State Historic Preservation Office, an independent archaeological firm hired by the Town as well as other state and local agencies. This included professionally prepared reports and expert testimony about the history and archeological significance of the greater Fishkill Supply Depot; 3. The Planning Board heard and considered conflicting evidence and opinions about whether the proposed development could have an adverse impact on historic or archeological resources. "The record reflects that it took the requisite hard look at that issue, and there is ample support in the record for its ultimate determination" that the project would not have an adverse impact on the Now that the litigation is complete, we look forward to working with the community on fulfilling the vision for Continental Commons.
