. Buffalo NY’s Sportsmen's Tavern just won a lawsuit against NYS regarding the advertisement of live music and selling tickets to live music events. According to the attorney representing them, The state agreed that we could advertise so-called background music, butour position was that it was an impediment of free speech because it’s content-based. Secondly, we’re already bound by all the safety and capacity regulations, so it doesn’t matter how people come to the establis...hment. The overturning by New York State Supreme Court Justice Frank Sedita allows for the Sportmen's Tavern to operate normal business operations within the already practiced guidelines for capacity and safety. If small venue theaters and performance venues offer the same safety and capacity regulations then the same rights should be applied to them. These businesses, such as the American Repertory Theater of WNY, are suffering and some face shutdowns from unfair standards set by NYS. An ongoing petition planned to be sent to NYS Governor Cuomo and NYS Senator Charles Schumer has been gathering signatures. Please review the petition, sign and share.
