To all the teachers in our area: We see you and we appreciate the work you are putting in to make our kids learn under these circumstances. Thanks!

Daniel P. Kuhn, Esq. 28.12.2020

Thankful for our clients, who followed us through an unprecedented year, and worked with us in new and different ways. We will continue to be here for you in 2021 and beyond!

Daniel P. Kuhn, Esq. 23.12.2020

Remember while people are stressing about a federal election: The federal government was never supposed to be something significant enough to stress about. In the meantime, local governments do important work every day and directly touch the people in significant ways. Turnout for elections should be the reverse of what it is: huge turnout for local elections and lower for national. Remember that next year and beyond, when social media isn't reminding you every 10 seconds about voting.

The Social Security Administration continues to conduct all hearings by telephone. This can be a daunting task for people seeking benefits. Don't go it alone! We have obtained benefits for many clients, even through this difficult process.

I met Mr. Steve Barnes on several occasions; he was never anything but kind and warm to me. My prayers are with his family and coworkers.

Labor Day - Today, we celebrate contributions workers have made to the strength, prosperity, and well-being of our country. Tomorrow, we return to work to make sure those workers can continue to bring their strengths to others.

True story: I once explained, to another lawyer, the difference between carbureted and fuel injected.

Three times this week I've told clients the same thing. It's become a mantra. It applies whether you're considering a medical treatment, a return to work, a return to school, or a settlement. Clients ask how those things will affect their case. My answer: Do not let your Workers' Comp case be your life! Do what is best for your life, your health, and your family. Just tell me what you are going to do, and I will figure out how to make it work with your case. That's it. I LOVE... to go into court with a client who is taking steps to improve their life and fight for them to be able to keep doing it. Let your Workers' Comp case be MY life, and go live yours.

Daniel P. Kuhn, Esq. 19.09.2020

Over 200 years on, our experiment in self-government continues. We have come a long way and still have work to do. We can do it, if we work together. Happy Birthday America!

Daniel P. Kuhn, Esq. 16.09.2020

Remember that Juneteenth was (is) part of a process, not a fixed moment in time. A "proclamation" is nothing without the people on the ground carrying it out. The work that brought about Juneteenth must continue today and beyond.

Daniel P. Kuhn, Esq. 06.09.2020

I got a haircut today. No, I'm not accidentally mixing up my personal page with this one. I'm saying this because it reminded me of the services we did NOT get during quarantine, that we will never get. So remember as you start to head back out there - PLEASE take care of the people taking care of you. Consider also paying them for the services you didn't get for three months, and won't ever need. If you can, it will make a big difference to them.

Daniel P. Kuhn, Esq. 01.09.2020

It's teacher appreciation week - teachers are still doing their jobs during this time, in unfamiliar and imperfect conditions. Thanks to them for keeping our education running! This is my wife's page for elementary music classes.

Questions about NY unemployment? We all have them right now. Send me a message and I will give you whatever answers I can find. I can't guarantee we have the answer (especially if your unemployment claim is "pending") but we will give it a shot. This is a free service.

Daniel P. Kuhn, Esq. 06.08.2020

It's not our regular offices but we do have our office phones, working on their regular phone numbers. This situation has given us all uncertainty. Call us and let us help you through.

Daniel P. Kuhn, Esq. 19.07.2020

This is an unprecedented time in America. Amidst this, insurance companies have not changed. Injured workers are receiving lowball settlement offers from insurance companies, trying to close cases with people who are short on funds. Don't get shortchanged! Even if you are not my client, we can meet virtually and evaluate any settlement offer, together, with no cost or obligation. Initial consultations are always free.

Daniel P. Kuhn, Esq. 15.07.2020

Since we are currently doing video and teleconference meetings for Section 32 Settlements, here is the Board's video on settling Workers' Compensation claims.

Daniel P. Kuhn, Esq. 30.06.2020

Positive story for our area. Hopefully she gets back to volunteering with the Girl Scouts soon!

Daniel P. Kuhn, Esq. 25.06.2020

We are here for your needs! We are available to meet using Zoom, Google Duo, or Cisco WebEx (the same program used for virtual hearings by the Workers' Compensation Board).

Daniel P. Kuhn, Esq. 09.06.2020

For the time being, we are staying open. Please consider whether your in-person visit can be done over the phone or virtually - we will use any videoconferencing technology you like - and know that we are undertaking extra cleaning precautions here.

Daniel P. Kuhn, Esq. 25.05.2020

The NY Workers' Compensation Board has made all hearings "virtual" and closed many hearing points. Even if you're not a client, call us, and we can explain what that means for injured workers. No cost or obligation. Just information.

Daniel P. Kuhn, Esq. 22.05.2020

I'm glad to boost this fundraiser for a family in our area in crisis.

It's icy out there... Did you fall in your employer's parking lot? Run off the road on the way to work? Sometimes, these situations can be covered by Workers' Compensation. Frequently, insurance carriers will deny these "grey area" cases and hope you go away. Don't go away! I would be happy to provide a 100% free consultation and let you know if your injury is a Workers' Compensation claim. Be safe on those roads this winter!

Daniel P. Kuhn, Esq. 24.03.2020

Merry Christmas everyone, and thanks for being a part of our success in 2019!

Daniel P. Kuhn, Esq. 20.03.2020

We are sponsoring this event in Brockport today and tomorrow. If you are in need, or know anyone in need, of toys or gifts this holiday season, please stop by.

One of the most frequent questions I get from clients: "Can I work/go to school/train while I am on Workers' Comp or Social Security Disability?" YES! If you're disabled, getting back to work or going to school are AMAZING things for your life. Those things might have an effect on your case, but I can handle that for you. Do what's best for your life and your family, and let us figure out how to make that work with your case.

The Board today is trumpeting a reduction in costs to employers. How have they accomplished this? By rejecting appeals, requests for hearings, requests for treatment, and even agreed-upon stipulations, for nonsensical and even unlawful reasons. In other words, by making it as difficult as possible for ANY parties, no matter what "side" they are on, to obtain justice. Don't navigate this morass alone - we are here.

For the second day in a row, the Board's Batavia hearing point is malfunctioning. This is affecting hearings, since the Judge appears only from Rochester via video. If you have a hearing today, even if we don't represent you, feel free to come to our office to appear virtually.

Daniel P. Kuhn, Esq. 16.10.2019

Today, feel free to celebrate Memorial Day your way. The freedom to do so is important. Maybe at some point, take a moment to learn about some of the people who made our world possible, and died doing so. In that we can honor them. A good idea, but as is typical with Albany, fraught with problems. A large problem is the requirement that members who want this tax break participate in 55% of all department activities. In my local district, Brockport, 55% of all activities would be 605 activities, or almost 2 per day every day of the year. Even in a smaller department like Byron, who reported 75 calls YTD as of 4/13, it's about one activity every other day.... Those are unrealistic expectations for anyone who needs to work a paid job while volunteering as a first responder, and I suspect few volunteers will meet the requirement. What Albany is doing is getting some nice PR and photo ops looking like they are doing something to encourage volunteerism, without actually doing anything. https://orleanshub.com/assembly-republicans-propose-state-/

A small family of Canada geese have returned for their third year to nest in the law school’s 5th floor atrium, located across the hall from our Clinical Legal ...Education office. We have named mama goose Ruth Bader Gooseburg and - rumor has it - as of this morning her eggs have hatched! Daddy goose keeps close watch over his family. Our Animal Law Clinic has set up a webpage so that we can chronicle their progress as well as a Goose Cam so that we can watch the family that have taken up residence in our building. Do you see the babies yet? #UBuffalo * https://www.law.buffalo.edu/be/clinics/animal/goosecam.html And please consider giving to our Animal Law Clinic : https://ubfoundation.buffalo.edu/giving/index.php

Has the Workers' Compensation Board sent you a "Proposed Conciliation Decision"? This confusing notice will affect your rights in Workers' Compensation! Call me today, and I will explain what your Decision means, and whether you need to respond to it. There's no fee unless we win you money, and I NEVER charge for an initial consultation.

Daniel P. Kuhn, Esq. 26.08.2019

This morning I had a hearing on an obscure section of the law, WCL 49-ee. As this doesn't affect my client, I went on his behalf and he stayed home. I did not charge a fee for this appearance. Don't waste your time in endless hearings, hire us! We don't charge a fee unless we win you money.

Daniel P. Kuhn, Esq. 18.08.2019

Tonight I am taking part in a forum about the First Amendment at my alma mater (and current second employer), Brockport. I enjoy helping to make sure the next generation of Americans is well-informed on their rights.

Congrats to our neighbors at United Memorial Medical Center for this designation, which will have positive effects on the health of our community.

I'm happy to be quoted in this article discussing the possible implications of marijuana legalization in NY. Prior articles only sought input from law enforcement. While their expertise is certainly valuable, there are many different and valuable perspectives on this important issue. This is an issue that will affect all of NY and we need as much input as possible.

Daniel P. Kuhn, Esq. 15.07.2019

The Workers' Compensation Board will reject documents for something as minor as not underlining a case number, even if you agree with the insurance carrier. Don't get buried in paperwork, let us handle it! All you should do is get better, and get back to work. We don't charge a fee unless we win you money.

Daniel P. Kuhn, Esq. 05.07.2019

The Daily News did not ask any local practitioners or anyone involved in healthcare or law (other than police) for their input on this story. That's a shame. Had they asked me, I would have explained to them that legalized marijuana will drastically lower arrests and imprisonment, thereby taking a large strain off law enforcement resources. Marijuana legalization will also result in a large reduction of our opioid crisis, since marijuana is proving to be a superior long-term... pain relief treatment in almost every way to pharmaceuticals. I would have also explained that driving while under the influence of marijuana is already illegal, and is already done every day on the roads of Genesee County. Nothing would change there. In short, what becomes of Genesee County if marijuana is legalized? Lower taxes, safer streets, and more treatment options for people suffering from long term pain. I don't see any bad in that at all. There will definitely be some growing pains while this is worked out, but legalization is the right move for NY (and the USA).

Fancy lawyer shoes? Nah. But I am doing that Mr. Rogers thing and changing when I get here!

Important news for Volunteer Firefighters in NY. Coverage is available for volunteers with five years of interior service, who subsequently develop cancer. After being fortunate enough to help the MOMS Club of Brockport Giftaway on Friday, I led the Brockport-area Cub Scouts and Boy Scouts in the Brockport Holiday Lights Parade. How long should I leave these lights on?

Daniel P. Kuhn, Esq. 08.05.2019

Have you made a difference in your community this year? Helped someone who needed it? Taken a step - big or small - to be better to someone? Well then I am thankful for you! #Thanksgiving

This accident should not have happened - A man shows up to help someone on the side of the road and is seriously injured because of a careless driver. If you see emergency lights of ANY kind, slow down and move over! The NY Move Over law applies to tow truck drivers as well! How much time will you gain by rushing past a tow truck? https://13wham.com//tow-truck-driver-seriously-hurt-on-390

Daniel P. Kuhn, Esq. 04.04.2019

You may have seen a larger Rochester firm advertising help with Social Security Disability cases, and telling you to call if you're "age 50 or above." Why age 50? Because, at that age, it becomes much easier to win a Social Security case. They want cases where they can collect a quick fee and move on. Do you want a lawyer who wants your case because they think it's easy money? Get a lawyer who wants to make a difference, not just a buck.

Daniel P. Kuhn, Esq. 01.04.2019

It's easy to love what you do when you have great clients. We love what we do!

The Social Security Administration employs some very talented and friendly people, but their regulations can be overwhelming! You'll be swamped with confusing paperwork and complex jargon from the first step of the process. Don't go it alone! We have helped many people through the process. And if we can't win your case, there's no charge to you. Call for a free, no-obligation consultation.
