USPTO Deadlines- COVID-19: Yesterday, the United States Patent and Trademark Office (USPTO) confirmed that it cannot adjust deadlines that are imposed by statute even if those deadlines are related to inaction because of COVID-19. The USPTO will waive certain petition fees should a patent or trademark applicant or owner seek to revive his or her rights, but the USPTO does not have the authority to change the deadlines that Congress imposed. By contrast, the European Patent Office extended all patent deadlines until April 17, 2020 and the European Union Intellectual Property Office extended all trademark deadlines until May 1, 2020. Revival at the Patent Office: The USPTO continues to express its distrust of applicants and IP rights owners. Last year, it required all foreign trademark owners to have U.S. practitioners associated with their cases because too many of them were ignoring their obligations to be honest with the USPTO. This month, the USPTO heightened the burden for many patent applicants and owners who seek to revive abandoned and lapsed patents. Previously, patent applicants or owners who ...requested revival would only need to allege that the failure to act timely in the face of a deadline was unintentional. But now, if the request is filed more than two years after abandonment, they should expect the Patent Office to require that they provide an explanation as to why they took so long to request revival.
