As noted in this NY Law Journal article, the judicial system is taking notice of Prosecutorial misconduct by charging and sentencing prosecutors who breach their duty to the public and commit crimes. I believe this is the first time this has happened in New York State
One of the greatest emotions one can experience is to see that what you did helped another. While we were devastated when we lost the trial, we knew we were right and proceeded to the New York State Supreme Court Appellate Division Second Department under the highly professional guidance of a great, compassionate appellate attorney by the name of Laura Solenger Esq. The case has resulted in the current office of the District Attorney reviewing their files and the DA filing a ...Motion to the Trial Justice, the Hon. William Condon, asking to dismiss the case because of prosecutorial misconduct and other reasons. I have great respect for the office of the DA, who I believe employs very honorable prosecuting attorneys. Sometimes, matters fall through the cracks for one reason or another. I finally realized the significance of this case when Sr. Aimee Koonmen, the Executive Director and founder of Bethany House in Nassau County, sent me a note saying, "Joe, you gave that man back his life." Murder case returned to the Supreme Court because of Egregious prosecutorial violations.
We lost the Murder Trial of People v Shawn Lawrence; but raised many, many motions for error by the People and the Court. The Court sentenced Mr. Lawrence to 74 years in prison for the Murder. We filed a Notice of Appeal to the Appellate Division Second Department and the Court assigned Laura Solenger Esq. to perfect the Appeal. I am happy to report that the Appellate Divison found an error, and then returned the case to the Supreme Court. The Supreme Court released my client on his own recognizance without bail. The Court noted Prosecutorial misconduct and a violation of the Brady Rule. (Maryland v Brady, US Supreme Court). I picked Mr. Lawrence up when he was discharged from the jail and brought him to see his girlfriend. I also bought them dinner.

In 2014 I was assigned by the Court to represent a man charged with murder, Shawn Lawrence. During the heated trial I made many motions to the Court for what I perceived as Errors, both by the District Attorney's office and the Court. All were denied. He was convicted and sentenced to over 70 years in jail. I filed an Appeal that was perfected by a fantastic Appellate lawyer, Laura Solinger Esq. The DA has recently admitted error and the case is being returned for motions and a possible retrial. Great effort on Laura's part.
To my friends and colleagues, I am honored and humbled to announce that the Executive Committee and the Board of Directors of the Suffolk County Bar Association have selected me to membership on the Board of Directors of the Bar Association. In that capacity, I will be co-chairing the Criminal Law Committee and participating as a member of the Lawyers helping Lawyers Committee.
