President Biden’s immigration proposal includes an 8-year pathway to citizenship for immigrants without legal status who were present in the United States as of January 1, 2021. Qualifying individuals will hold a temporary status for five years, and then after meeting specific requirements such as background checks and payment of taxes, they will be eligible to apply for a green card. After three years of being green card holders, they will be able to apply for citizenship. DACA and TPS recipients will be able to apply for a green card immediately.
