For Governor Andrew Cuomo and anyone else who needs a refresher: the United States Constitution and the New York State Constitution are still the supreme law of... the land. Those of us in public service swore an oath to uphold both, this duty does not end during a time of crisis. Momentary popularity and even good intentions do not supersede these unalienable civil liberties. The people of New York must make smart decisions. Governor Cuomo and the Department of Health can caution New Yorkers not to gather in large groups and can urge worshippers to practice their religious services virtually, but cannot issue any rule or enforceable penalty that violates the United States Constitution or New York State Constitution, even under the continued State of Emergency due to COVID-19. Any attempted executive action taken with such a blatant disregard for the Constitution undermines the legitimacy of every other action and inhibits the state of New York from responding to this pandemic with public trust and participation. - Assemblyman Doug Smith
