Bootleggers Sell Counterfeit ‘U2’ Merchandise at Live Nation Tour; TRO Denied Irish rock sensation U2 has begun touring the country, but their fans aren’t the only ones in tow. Live Nation, the company who has the exclusive rights to sell merchandise bearing U2’s logos and trademarks at these events, has noticed certain merchants following the band around to sell U2 merchandise as well. On May 19th, Live Nation filed a Complaint against certain defendants they described as o...rganized Defendant Bootleggers whom they frequently observe...selling Unauthorized Merchandise at many of the venues. Since the tour is set to continue throughout the summer, Live Nation applied for a temporary restraining order (TRO) to enjoin the defendantswhom Live Nation has not yet been able to identifyfrom continuing their alleged trademark infringement. On May 21, the Central District of California denied the TRO on the basis that, while it understands the Plaintiff’s difficulty in identifying the names and addresses of the unknown defendants...we are concerned that Plaintiff has not made adequate efforts to do so. The court reasoned that placing the TRO on a vague group of unidentified merchants would not give them the chance to defend themselves and would constitute a broad-based order preventing any and all members of society from engaging in future behavior that might or might not later be found to have violated the plaintiff’s rights.
