Important Supreme Court ruling. The Supreme Court has carved out an exception to when evidence gathered during an illegal search by the police may subsequently be used against you in court. In sum, if the police stop you without probable cause but then discover that you have a warrant, the police may use any evidence gathered prior to the discovery of that warrant.... Whereas in the past, even if the police discovered that you have a warrant, the police would not have been able to use any evidence gathered during the illegal search portion. The purpose of the old rule was to prevent the police from selectively stopping persons without cause, finding (or planting) something illegal on them, and then using that evidence. With the new ruling, the police have more leeway to randomly stop persons for no cause, search them, and then if they find evidence they can look to see if any warrants are out, and if they find a warrant, then they can use that illegally found evidence in court. This ruling will unfairly target the lower class because many warrants are issued for simply failing to pay fines. And it is the poorer folks that cannot typically afford to pay an attorney or the requisite fines to clear these low level warrants. Thus, in light of this ruling, the lower class will likely face increased harassment and illegal searches by the police. This law is likely not going to change anytime soon so make sure you and your family and friends don't have any warrants and be careful out there.
