The legal rationale in this massive opinion is not as important as the sentiment that the death penalty is wrong for a teenager who would probably not have committed a heinous crime if not for the influence of his older brother. I am not sure this defendant would not be better off if he was killed and martyred as opposed to lifetime in a max facility. Even though I, like the Court here, know how ghastly this crime was, like it or not, I don’t believe in the death penalty for any case but especially one like this. Effective January of 2020, NY increased a prosecutor’s discovery obligations in all cases. In fact, prosecutors may not condition a plea offer on a defendant’s waiver of these discovery rights. However, this good law had horrendous consequences for deserving immigrants trying to negotiate vacaturs and repleaders on old cases that were causing devastating immigration consequences. This was because prosecutors could not agree to vacatur and the acceptance of new pleas without c...ompleting the burdensome task of finding these very old pieces of discovery. They balked at this challenge and many stopped negotiating for these beneficial dispositions. Thankfully, after my lobbying, the Legislature enacted Sec 245.75(2), which excepted the waiver prohibition on agreements to vacate and replead. This new law has encouraged dispositions that will avoid destroying the lives of long-time NY residents. Bravo. See more
