Suffolk County’s ban the box law takes effect today, August 25, 2020, bringing a big change for prospective employees as well as employers. The law prohibit...s a conviction history checkbox from appearing on job applications and allows employers to inquire about a job applicant’s criminal conviction history only after an initial interview has taken place. The aim of the law is to ensure fair employment screenings by giving applicants the chance to showcase their skills and qualities without being denied that initial opportunity due to a conviction history. A FEW THINGS TO KNOW: 1 The law applies to any employer located in Suffolk County with 15 or more employees. 2 Prospective employers cannot ask questions regarding or pertaining to an applicant’s prior criminal conviction on any job application. 3 Consideration of a candidate’s prior criminal convictions may be considered only after an initial interview takes place. In cases where there isn’t an interview process and applicants are hired based strictly on their resume, the employer must inform the applicant whether a criminal background check will be conducted before the employment is to begin. WHO ENFORCES THIS?: Violations may be alleged to Suffolk County’s Human Rights Commission, which may investigate and seek civil penalties and damages in accordance with county code.
