If you have more than $50,000 in net assets in New York state, your loved ones have to go to Surrogate's (Probate) Court to get legal permission to receive or access your assets. These assets can be cash, retirement accounts, and any kind of real or personal property. If you pass on with a Will, the probate process is relatively smooth and quick. If you do NOT leave a Will, the process will be much longer (and will be expensive if you engage an attorney). And if you have Minor Children, you can only appoint a Legal Guardian for them through your Will. Without a Will by you, potential guardians (e.g. your siblings) will have to go through a complex petition court process to get custody of your kids.
