76 years ago today, the greatest military invasion in history took place- when Allied Forces stormed the Normandy coast by air and sea; to establish a foothold in Hitler’s Europe. In less than a year, those forces were able to eradicate and destroy the most evil regime in human history. This is American Exceptionalism- this is who we are as a nation. In Lincoln’s 1863 Gettysburg Address he said Americans have a duty to ensure government of the people, by the people, for the people, shall never perish from the earth. Today we remember the sacrifice of all those who fought to take the Normandy beach head and for those who fought to protect this very ideal.

Law Day is a celebration of the Rule of Law. As a former Director of the Richmond County Bar Association, I served on the Law Day Committee. I fondly recall... working with the great members of the committee to put together a great day for Judges, Attorneys, and most especially Students from local Staten Island schools. The students would participate in essay writing, and would get a tour of the Courthouse. A great day for all, and a proud day for our legal community. This is an article I wrote, that was published in the New York Law Journal, back when I was a Director of the Richmond County Bar Association in 2015. It was quite an honor to be published next to some highly respected members of the legal community, members of the bench and the bar; in the New York Law Journal. This was a truly memorable and humbling experience for me as a member of the bar. Later on when I served as a State Assemblymember- I had the distinct honor of procuring a Proclamation to recognize the lifetime achievements of a dear friend, the late Paul F. Scano, Esq., which was presented to him at a Law Day ceremony. Law Day will always be very special to me. See more

When considering your family need for a Special Needs Trust and/or ABLE account, call my office at 718-701-3100 to talk about the suitability of these savings tools for your loved one's needs. An ABLE account is not an ideal vehicle to manage significant third party funds due to the likelihood of a Medicaid payback claim upon the death of the beneficiary, unless there is also the strong likelihood that all third party funds contributed will in fact be spent before the beneficiary dies. For most individuals with disabilities, an ABLE account is not a substitute for comprehensive SNT planning, but it may be a helpful secondary tool to help secure their financial futures. This law allows executors and other representatives to deal with someone’s digital assets upon death. Prior to the new law, digital service providers (ex. Facebook, Google) frequently refused to grant access to a decedent’s accounts, relying on federal privacy laws. Now, a user may direct the disclosure of some or all of the user’s digital assets, including the content of electronic communications. If there is no directive set forth in an online tool, then the user may direct disclosure by will or another instrument. There is a legal distinction between the disclosure of digital assets versus the disclosure of the content of electronic communications.
