I am looking for someone who has a child that is currently in detention serving more than 6 months in the capital district based upon a family court order, preferably one who went to trial but a trial is not necessary. Or a child who is currently facing detention of more than 6 months before a family court judge.... The issue to be raised is that Family Court Act 435 is unconstitutional as it deprives a child of their constitutional right to jury trial when facing more than 6 months in jail or in state detention. In re Gault, 387 U.S. 1 (1967), the U.S. Supreme Court decision that held that juveniles accused of crimes in a delinquency proceeding must be afforded many of the same due process rights as adults, such as the right to timely notification of the charges, the right to confront witnesses, the right against self-incrimination, and the right to counsel. If a child is entitled to other constitutional rights when facing detention or imprisonment, they should also be entitled to their constitutional right to a jury trial. The decision to have a jury trial or not should be up to the parents and the child and NOT the family court judge. 4. I am looking for three (3) fathers who are facing imprisonment in family court for non-payment of child support. A single issue for each one. d) They are being deprived of their constitutional right to a public trial as Family Court Act 433 is being enforced in violation of Uniform Rules for Family Court 205.4. The court is being illegally closed. e) They are being deprived of their constitutional right to a jury trial as Family Court Act 435 is unconstitutional. f) That Family Court Act 439 that creates the office of support magistrate is unconstitutional as it violates the NYS Constitution, Article VI, 13 that states the composition of the family court.
