IN THE NEWS: McBRAYER LAW SETTLES BANKER'S GENDER DISCRIMINATION/SEXUALLY HOSTILE WORK ENVIRONMENT CASE FOR THREE TIMES ORIGINAL OFFER: Banker laid off following months of supervisors' harassment due to her post-maternity leave caretaking schedule. Within hours of informing HR Hotline of new pregnancy, client was let go by executive whose sexual advances client rejected more than a decade earlier. Bank said: 1) they never knew; 2) times are hard; and 3) timing is coincidence. McBrayer Law said: "Timing is everything." One letter and 4 months of negotiations later, case settled for 3 times original offer plus benefits, and executive & supervisor terminated. Company said: "It's the economy, stupid!" McBrayer Law said: "Not so fast!" One letter and 4 months of negotiations later, client was paid quadruple company's original severance offer. IN THE NEWS: McBRAYER LAW'S 2020 WRAP-UP: In 2020, McBrayer Law successfully represented victims of sexual harassment and sexually hostile work environments, gender, race, age, and sexual orientation discrimination, as well as victims of retaliation and breached contracts. In so doing, McBrayer Law turned its clients' unfortunate furloughs and layoffs into profitable career moves. As one client wrote: "I could not have had better representation and guidance throughout this process. On to bigger and better!" Despite a tough 2020, McBrayer Law gainfully represented clients in Los Angeles, Chicago, and New York, had two sexual harassers fired, and served as chief legal counsel to a Manhattan-based corporation. IN THE NEWS: McBRAYER LAW SETTLES GAY FINANCIAL ANALYST'S DISCRIMINATION CASE FOR 2.5 TIMES ORIGINAL OFFER: Gay business executive was harassed by colleagues under newly-appointed supervisor's homophobic watch, but only complained when unwarranted disciplinary action set him up for firing. Corporation claimed client's refusal to comply with disciplinary protocol constituted a voluntary resignation. McBrayer Law said: "He didn't quit!*" (*yet.) One letter and 4 weeks of negotiations later, client was paid two-and-a-half times corporation's original severance offer. IN THE NEWS: WHAT NOT TO DO ON A ZOOM CALL 1) Yesterday, CNN chief legal analyst/The New Yorker reporter Jeffrey Toobin, Esq. was literally caught with his pants down, exposing himself and masturbating during a Zoom call with his co-workers from The New Yorker and WNYC staff; 2) During a break in the discussion concerning the upcoming Presidential election, Mr. Toobin engaged in phone sex on a second call, apparently unaware his colleagues -including New Yorker writer Masha G...essen - could both see and hear him; 3) Employers don't take such multi-tasking lightly; 4) The New Yorker promptly suspended Mr. Toobin to investigate the incident further; 5) Mr. Toobin has also taken a "voluntary" leave of absence from CNN "while he deals with a personal issue;" 6) Title VII as well as NY state and municipal law protect employees from sexually hostile work environments, even when the workplace is remote; 7) Those laws not only protect employees from sexual harassment at the office, but also at outside work events, office parties, and at home on their computer and phones; 8) In other words, we're here for you Masha. IN THE NEWS: WORKING WOMEN BEAR BRUNT OF PANDEMIC'S NEGATIVE IMPACT 1) According to The NY Times, in February 2020, just before the pandemic's onset, women in the US reached a milestone: for the 1st time, more than half the nation's civilian non-farm labor force were female; 2) Even so, married working women performed more than 70% of their family's childcare responsibilities; 3) Post-pandemic, those responsibilities have nearly doubled, on average increasing from 30 to 59 ho...urs weekly, yet working mothers continue to spend some 15 hours more weekly on childcare than working fathers; 4) According to "Women in the Workplace 2020," in September, some 865,000 women left the US workforce as opposed to 216,000 men; 5) 32% of these women - versus 12% of the men- stopped working due to pandemic parenting obligations; 6) Moreover, some 2 Million working women are currently considering dropping out of the workforce; 7) This outcome is not only the consequence of ongoing economic disparity in the US workforce - women are still paid significantly less than their male peers- but also ongoing discrimination against pregnant women and female caretakers; 8) As Harvard economics professor Claudia Goldin aptly put, previously existing workplace inequities are now "on steroids;" 9) Not surprisingly, 57% of working moms (versus 33% of working dads) recently reported being depressed; 10) Sadly, the exodus of these working moms from the workforce not only will reduce their earning potential and professional opportunities, but negatively impact generations to come.
