NEW YORK's GOVERNOR : NO EVICTIONS UNTIL JANUARY 2021 New York Governor Andrew M. Cuomo announced on Monday September 28, 2020 that he will extend the current New York eviction moratorium - set to expire Oct. 1 - to next year. This will continue protections for tenants and homeowners who have been unable to pay rent and mortgage during the public health crisis. Cuomo will sign an executive order extending the eviction moratorium, known as the Tenant Safe Harbor Act, to Jan. ...1, 2021. The moratorium also protects homeowners from foreclosure for nonpayment of mortgages during the coronavirus pandemic. These moratoriums clearly protect tenants and homeowners. However, what if you are a landlord ? This current situation raises many questions for landlords facing financial difficulties due to tenants who are not paying, and who cannot be currently evicted. Despite the moratorium, there are preliminary steps that we have recommended our landlord clients take. These steps will place them in the best possible position to protect their interests as the situation evolves. COVID-19 UPDATE : McDermott, Pierro & Mandery, LLP remains working for our clients during the COVID-19 Pandemic Situation. As of May 25, 2020, the New York State Courts have indicated that they will accept new matters being filed electronically. Despite this, the New York State Courts are still not working at full capacity due to the COVID-19 situation. We anticipate that there will be a delay in the processing of new court matters, as the Courts will be facing a flood of ...new filings. We continue to monitor updates from the Courts on a daily basis. The health and safety of our staff, and those we come in contact with in our practice, is a top priority. Therefore, in accordance with the current directives of Governor Cuomo for non-essential businesses, our staff continues to work remotely, and have suspended face-to-face meetings with our clients. We do remain connected, are actively monitoring emails and phone messages, and are able to conduct business. We wish you all well, and appreciate your consideration during this time. Thank you. As of March 22, 2020, the New York State Courts are not accepting filings of any papers in pending cases, or new filings for non-emergency cases. Emergency cases are limited to a very small and defined group of matters, and generally do not include cases in the areas our practice concentrates on. We continue to monitor updates from the Courts on a daily ba...sis. The health and safety of our staff, and those we come in contact with in our practice, is a top priority. An update from Sharon Simon, Esq., Of Counsel to our firm, who brings nearly four decades of employment/labor law expertise to our work with our business clients: Employers should be aware that the U.S. Department of Homeland Security has issued a revised I-9 form (dated October 21, 2019). These forms are, of course, used to verify employees' eligibility to work in the United States. Forms, in English, Spanish, fillable PDF, and non-fillable paper versions, are available ...on the Department of Homeland Security Website at www.uscis.gov/i-9. Employers may start using the new form now, or they can continue to use the previous form, dated 7/17/17, until 4/30/20. Starting on May 1, 2020, all employers must use the new revised form.
