S1286 has passed the Senate. The bill will be sent to the Assembly if it has not yet passed that chamber. If the Assembly already passed this bill, it will be sent to the Governor for signature (approval) or veto (rejection).

Congress has signed this into law. CMS must now exercise their waiver authority. Further, EMS agencies must have protocols in place to cover when treatment in place is appropriate.

This bill has been assigned as a "same as" bill in the Senate: S3550 What this Means: In New York State, both the Senate and Assembly must pass a bill before the Governor can consider it for signature (approval) or veto (rejection). S3550 is an identical version of A1842 in the Senate. Experienced observers know that a bill with a same as in the alternate house is an important early sign that a bill could pass both the Senate and Assembly. It indicates that individual lawmakers in each house are supportive of the bill.

I support this bill although it requires 2 signatures for the insurance check. I would prefer that the insurance carriers be required to issue the check to providers, whether or not they participate in a reduced fee schedule. This is a compromise. It would work provided banks take note of the fact that a patient cannot just sign the check and cash it, and that it requires a second signature by the provider. When you vote in favor of this bill, it does allow for you to make comments.
