Please address the "Disproportionately Unequitable Market Structure" to NY Hemp Farmers, small dispensaries and NY citizens who are directly impacted by Prohibition of hemp flower. Hemp farmers have paved the way for marijuana legalization. Yet hemp flower is NOT marijuana and therefore needs to be released from current over regulation. Legally grown CBD hemp that tests at the legal limit of .3% THC is a FARM CROP much like hops. Hemp flower is the only FARM crop a farmer is banned from selling direct to consumer in NY. We can sell our flower out of state but not in NY. Why? Your NYDOH regulations do not support our right to farm when it dictates we can only sell to a handful of NY Processors. In essence you're turning us into sharecroppers for the NY Processor's monopoly. We have every right to direct sale hemp flower to consumer. The growing of CBD hemp flower is facilitated by NYSDAM as a raw flower & leaves crop. Processors, manufacturers and retailers are the ones who need NYSDOH regulations NOT the farmer. Consumers, dispensaries and manufacturers have every right to purchase hemp flower direct from farmer. They currently must purchase hemp flower from other states. Meanwhile NY Hemp Farmers have a surplus of hemp flower in storage and no opportunity to sell in NY because NY Processors are not buying and set the market price. My neighbor buys hemp flower from Oregon to make her teas and tinctures but can't buy from me. This hemp flower prohibition being imposed on the farmer is unconstitutional and does not support NY economy, NY farmers or NY citizens. Marijuana is a schedule1 substance and needs to be regulated. Hemp was descheduled under the 2018 Farm bill. New York prohibition of hemp flower is unequivocally discriminatory to the Hemp farmer and unconstitutional. And text STATE to 50409 & follow prompts Subject: NYDOH Hemp Comment I oppose the ban on the sale of raw hemp flower direct to consumer by NYSDOH. I support NY hemp farmers right to sell their legally grown and tested hemp flower direct to consumer with a certificate of analysis. I support the addition of a Micro Grower/Processor/Retailer category to current NYDOH regulations.
