This Fall our firm negotiated a $4,500,000 settlement on behalf of a union carpenter who was injured when he and his co-workers were attempting to maneuver the first of a series of 12-foot long, 500-pound, steel I-beams into a service elevator, and the beam fell onto his shoulder. The building owner and general contractor at the construction site had failed to provide the workers with the proper equipment, such as a crane, a boom or an exterior hoist, to lower the beams from... the top floor of the building to the street 18 floors below. Our client’s lower back buckled during the incident, and he was taken by ambulance to Beth Israel Medical Center, beginning a course of treatment that included neurologic care, physiatric care, pain management and ultimately surgery. As a result of injuries, he was unable to continue his employment as a construction worker. This settlement will provide this then 27-year-old single father, who is raising two young children on his own, with compensation for the pain and suffering caused by this incident, and financial security for his family. He didn’t go to the hospital and didn’t initially feel pain in his neck, but after three weeks went to his doctor with a sore neck. 6 months later he needed surgery to repair an injured disc in his neck. Three years later were able to recover $1,925,000 for his pain and suffering and early retirement from the union.
Big wins for our construction worker clients!!!! Over the last few months, the attorneys at Morgan Levine Dolan have successfully proven the injuries sustained by our clients in construction site accidents were 100% the fault of the property owner and general contractors. The Courts in NY have issued several decisions confirming these accidents were only preventable if the owner and GC had given our clients the proper safety devices and protections required under the law. These accidents were preventable. These life changing injuries were preventable. And now those responsible for severely injuring our clients will pay!
After a few recent settlements and awards, the attorneys of Morgan Levine Dolan have surpassed the $200 Million mark!!!
