OCCUPATIONAL ILLNESSES: WORKERS' COMP PUZZLES You may have recently read the Daily News story about Diane DiGiacomo, an ex-ASPCA worker who is dying from a 9/11- related cancer. She "spent three months near the shadow of the smoldering....World Trade Center saving dogs and cats left behind in nearby apartments." As a result, she is now gravely ill. The News article goes on to detail how the New York Workers' Compensation Board, shockingly, denied Diane's Workers' Comp clai...m. I do not know all of the details, (it wasn't our case) but suffice it to say this is a sad story. Occupational illnesses of all kinds can be difficult to prove at the Workers' Compensation Board. The Attorney General Eric T. Schneiderman's own website explains it this way: Consider this example. A nurse who contracts tuberculosis from a tubercular patient would be entitled to benefits for an occupational disease because it is an ordinary feature of a nurse's employment to be exposed to persons suffering from such diseases/ However, an office worker who contracted tuberculosis for being exposed to a co-worker would not be considered to have contracted an occupational disease because there is nothing in the nature of office work which would expose all persons doing that type of work to tuberculosis.
