Over the past 8 years, I have dedicated myself to Corvain Cooper’s freedom from the unjust and unusually cruel sentence of life imprisonment without the possibility of parole for selling marijuana under the Federal Three Strikes law. The system failed Corvain Cooper; Barack Obama’s promises not to seek lengthy prison sentences for non-violent drug offenders and to grant clemency to those that were unjustly impacted proved to be hollow promises. Eric Holder’s Justice Depa...rtment policies not to do the same were neither followed nor enforced by the United States Attorneys. The Federal court system also failed Corvain Cooper by repeatedly overruling his challenges to his conviction and sentence, even after his two prior non-violent drug convictions were removed from his criminal record. On behalf of my client and friend, Corvain Cooper, we would like to thank all of the people who have stood by us and supported us in our quest for justice. You gave us the strength to carry out our mission. I personally want to extend my deepest gratitude to Alice Johnson, Amy Povah, Corvain’s sweetheart of a mother Barbara, and of course, President Donald Trump for making this one life breathe easier. D.C. Appeals Court Rules Against General Michael T. Flynn, Will Allow Case to Go Forward 8-31-2020 https://youtu.be/6XjE9ag5Nrg https://www.appealslawgroup.com/d-c-appeals-court-rules-ag/... The D.C. Circuit Court of Appeals today ruled against General Michael T. Flynn in his Petition for a Writ of Mandamus. Flynn sought to have the D.C. appeals court command Judge Emmet Sullivan to grant the Department of Justice’s motion to dismiss his case. Reviewing the case en banc, the full Circuit Court of Appeals reversed its initial decision, which granted the petition. General Michael T. Flynn pled guilty to making false statements to FBI agents in December, 2017. Since then, the United States Department of Justice released additional exculpatory material, called Brady material, that cast doubt on whether Michael Flynn committed any crime at all. The Department of Justice filed a motion to dismiss the case, and Judge Emmet Sullivan ordered a hearing to be held for the Government to explain its reasons for dismissing the case. Flynn then filed a Petition for a Writ of Mandamus, asking the D.C. Circuit Court of Appeals to order Judge Sullivan to dismiss the case without further inquiry. The initial panel of 3 judges granted Flynn's petition, and Judge Sullivan sought review of that decision before the entire Circuit Court. The D.C. Circuit Court granted the request, and reversed itself, sending the case back to Judge Sullivan for further inquiry as to the Government's reasons for dismissing the charges. The D.C. Circuit held today that Michael Flynn cannot get this extraordinary order - mandamus - at this time because he still has the ability to appeal if and when Judge Sullivan denies the Government's motion to dismiss the case. The Circuit Court ruled that both Flynn and the Government can take a regular appeal if the motion is denied. This decision was based, in part, on Judge Sullivan's representations to the D.C. Circuit court that he will not necessarily conduct an in-depth inquiry or require witnesses to testify in deciding the motion. The decision also stated that there still is the possibility of a future mandamus petition if the Judge Sullivan strays beyond his judicial powers to decide the motion to dismiss. Finally, the D.C. Circuit declined to reassign the case to a new judge. The two judges that originally ruled in Flynn's favor filed dissenting opinions. Judge Karen LeCraft Henderson and Judge Neomi Row disagreed with the 9 judges in the majority. Flynn has the option of appealing to the United States Supreme Court The case is In Re Michael T.
