"We do think it's important to weigh in on whether there's legal authority, and we don't find it, absent an actual or imminent attack against us or possibly against our allies," Mark Shulman, chairman of the bar association's Task Force on National Security and the Rule of Law, tells Newsweek on Wednesday. "These are not laws created by egghead legal scholars like me. They're very practical laws intended to produce stability, predictability and security for the nations that have created them."
In a letter to President Trump, the City Bar has called attention to the requirements of the U.S. Constitution, federal legislation, and international law with respect to the commencement of war, and, in particular, to the strict limits of the Constitution and laws imposed on the power of the President to unilaterally commit the nation to war. The New York City Bar Association offers its deepest condolences to all those affected by the horrific mass shooting in Las Vegas. This heartbreak touches every... American and we grieve for those who were injured and for families who lost loved ones. We are thankful for the quick and heroic actions of law enforcement and first responders. And while we must grieve, we also must act. The tragedy in Las Vegas, the worst mass shooting in modern American history, is the latest in a series of mass shootings in a country that makes it far too easy for one person to arm himself legally - with the capacity to kill and maim scores of innocent people in less than a few minutes’ time. The Jones Act has been waived for Puerto Rico for 10 days, providing much needed immediate aid and supplies for the island. However, the City Bar has called on President Donald Trump to grant a long-term waiver of the Act requirements "in light of the catastrophic devastation caused by the onslaught of three successive hurricanes, the tragic impact on personal and commercial life on the Island and the urgent need for unfettered delivery of essential materials and services to help rebuild and restore life and activity to Puerto Rico and its residents."
