A Contra Costa County jury has awarded $11.7 million to the family of a man who died on a badly maintained stretch of county road while trying to help an injured motorist.

That matter settled after we rested our case before the jury and the judge then denied all of the Defendants’ procedural motions to dismiss the case. Both clients, who required surgery and the internal placement of medical hardware as a result of the fall caused by the Defendants’ negligence, testified in a clear, honest, and straightforward manner. This, no doubt, helped convince the jury and judge to find in their favor. This is a very important decision in the world of libel law. The Court of Appeals for the Second Circuit Court ruled that Ms. Reid, an MSNBC host and personality, did not have immunity from suit under CDA Section 230. She was the author of the alleged defamatory content and also "developed" the content of others by embellishing the false claims even further with her own words and actions. The Court left open the issue on whether one commits and is liable for defamation by "re-tweeting" or copying and pasting someone else's defamatory content.
