Workers’ Compensation is under attack. When Albany begins its annual budget battle, the injured worker is an easy target as they’re asked to bear the burden and take yet another hit. With this year’s anticipated budget shortfall, we have no doubt Albany will once again have the injured worker in their sights. Please help us protect New York’s injured workers by sending an email to the Governor, your State Senator and Assembly member by clicking this link: https://www.prote...ctinjurednewyorkers.org/. The link takes you to a page that will send a pre-written but editable letter asking our elected officials to pass legislation that will protect and improve injured workers’ rights. Thank you for taking the time to protect the rights of New York’s injured workers. The Law Offices of Polsky, Shouldice & Rosen, P.C.

For more than 7 months, officials were aware there was a problem and failed to warn the more than 1,000 people employed at the busy bus depot.

WE ONLY HAVE THROUGH OCTOBER 23RD TO TAKE ACTION! #ProtectInjuredWorkers To Workers in New York State:... Right now, workers in New York State receive some financial compensation when they experience permanent damage to an arm, leg, hand, foot, or eye. Workers receive this money because they gave up the right to sue their employers for workplace injuries in the original workers’ compensation bargain. Workers were assured that as part of this agreement they would be compensated for their injuries through the workers’ compensation system. As you may have heard, the Workers’ Compensation Board recently released proposals that would drastically reduce and eliminate compensation benefits for injured workers. The proposals are being pushed by business owners and employers who want to renege on the deal with workers, making sure that they receive nothing for a work-related broken arm, torn rotator cuff, joint replacement, etc. We need your help! The proposals are totally unfair and will significantly harm all New York State workers, their families, friends and co-workers. The bottom line is that proposals would take the money to compensate injured workers and give it to big businesses and insurance companies. The recently released Workers’ Compensation Board proposals are exactly what the big businesses and insurance companies asked for. We must stand together to support New York’s workers and reject these destructive proposals. Please make your voice heard to the State legislature and to the Workers’ Compensation Board by clicking here: www.nyworkerscompensationalliance.org/protectinjuredworkers Read a study by the WCA that illustrates how these new guidelines could drastically reduce or eliminate workers' compensation benefits: http://workerscompny.com//09/WCCArticleOnWCASLUPosition.pdf

The business council and the insurance companies are at it again. WE NEED YOUR HELP. As if the capping Worker’s Compensation payments and cutting back on medical benefits weren’t enough, the Business Council has successfully convinced the New York State legislature to change the way permanent injuries are evaluated. The Workers’ Compensation Board has been directed to produce new guidelines by January 2018 to address permanent losses of use to your extremities-arms, legs, han...ds and feet. THESE NEW GUIDELINES WILL BE EFFECTIVE IMMEDIATELY, EFFECTING CURRENT OPEN CASES AS WELL AS NEW CASES. The Business Council is the hugely powerful lobbying arm and is made up of many of the largest insurers and businesses in New York state. The direction to change the guidelines was their idea, so you can bet that a change in the guidelines means one thing, A FURTHER REDUCTION IN BENEFITS FOR THE INJURED WORKER WHILE EMPLOYERS AND INSURANCE COMPANIES INCREASE THEIR PROFITS ON THE BACK OF THOSE SAME WORKERS. NEW GUIDELINES MEAN LESSENING THE VALUE OF OPEN AND FUTURE CASES. As you know, we at Polsky, Shouldice & Rosen, P.C. have always been at the forefront of the fight for injured workers’ rights: lobbying Albany, speaking directly with local Assembly and Senate leaders and leading local bar associations. HOWEVER, IN THIS FIGHT, WE NEED YOUR HELP. BELOW IS A LINK FOR A SURVEY WHICH WILL BE PRESENTED TO THE WORKERS’ COMPENSATION BOARD AND THE NEW YORK STATE LEGISLATURE TO GIVE A VOICE TO THE FORGOTTEN INJURED WORKER. PLEASE TAKE A MOMENT AND COMPLETE THE SURVEY AND HELP US STEM THE CONTINUED ASSAULT ON INJURED WORKERS’ BENEFITS. IT IS HUGELY IMPORTANT TO CONTINUING OUR FIGHT.
