New Eviction and Mortgage Laws As courts around the state of New York begin to reopen, they are worried about the public health risks that may come with an influx of cases, especially those pertaining to eviction proceedings. As he continues to lift restrictions on various regions of the state, NYS legislature has also made modifications to a few laws related to residential evictions and mortgages. ... New York regulated institutions shall make applications for a forbearance period of 180 days, with the option for another 180 days. The forbearance can be dated back to March 17, 2020, and it will apply to forbearance on any residential mortgage for anyone who is facing financial hardship. This is a modification of previous language, where the financial hardship no longer must be a direct effect of the COVID-19 pandemic. Moreover, the period of loan can be extended for the length of forbearance and any late fees as a result will be waived. Secondly, the language directly related to COVID-19 has been altered to a more generalized to state disaster emergency declared pursuant to executive order 202 of 2020, potentially increasing the order’s applicability to future events. Lastly, landlords are no longer required to present a signed affidavit claiming that their tenants are/are not facing financial hardship when conducting eviction proceedings. Supreme Court Affirms Validity of 'Booking.com' Trademark In its first case to ever be conducted as a remote oral argument, the Supreme Court ruled that a generic word combined with .com can be used to create a federally protected trademark. The court centered around Booking.com, a company that the Patent and Trademark Office denied due to the generic nature of its title. The decision passed 8-1, with Justice Styer providing the only dissenting opinion. The justices stated... that while Booking is a generic term, the addition of .com makes it not generic to the public, as it is recognized as its own company/service. Justice Ginsberg wrote, Because ‘Booking.com’ is not a generic name to consumers, it is not generic, indicating that consumers do not see other travel companies like Travelocity as a Booking.com service. The Patent and Trademark Office argued a precedent that corporation titles with Company or Inc. cannot serve as a trademark, but the court responded that unlike the cases with these terms, only one party can hold a website domain. Consumers are excited about the decision, as companies such as Hotels.com and Wine.com are now deserving of trademark recognition, while many attorneys say that the decision establishes a precedent that welcomes future litigation. Trademark attorney J. Kevin Fee of Morgan, Lewis & Bockius LLP agreed, saying Whenever the court rejects ‘per se’ rules and adopts fact-dependent analysis, it always invites litigation. The decision indicates future consideration of the primary significance of a title versus a class of goods and services, extending trademark rights to companies with generic names accompanied by a .com domain. A Moratorium on Evictions Ends On Saturday, June 20, Governor Cuomo’s eviction moratorium was lifted, opening the housing courts and causing panic across New York. The moratorium was originally enacted in response to the stay-at-home order following the onset of the COVID-19 pandemic, as millions across the state became unemployed. Now, every eviction case from the past three months as well as those that went stagnant in March due to the outbreak are fair game for the courts.... Fifty New York City lawmakers have called on Cuomo to extend the moratorium. In the original plan, the courts would reopen for in-person hearings, but this is no longer the case due to a potential risk of increase in the spread of COVID-19. Now, eviction commencement documents can be sent through the mail or by NYSCEF (electronically) and hearings will be held virtually. With the lifting of the eviction moratorium also came a second order, promising continued protection until August to those in cases who are eligible for unemployment or who have faced financial hardship as a direct result of the COVID-19 outbreak. However, this vague qualification has caused further confusion for many landlords and tenants. Recent studies show that over 28 million people are at risk of eviction, and it is expected that over 50,000 cases will be filed with the reopening of the housing courts. The situation is complicated for landlords, many of whom are worried about losing their properties. In the past three months, an estimated 25% of tenants have not paid rent. However, landlords and attorneys who mail in eviction filings must now sign an affidavit swearing they reviewed all eviction restrictions and state in good faith that their case applies. If a landlord wrongfully interprets the confusing qualifications set forth by the government, he/she may be penalized. A Tidal Wave of Bankruptcies is Coming This year, regardless of economic trends in coming months, the number of filings for mega bankruptcies ($100 billion) is expected to surpass any since the Great Depression, and the amount of filings over $100 million will challenge 2009 statistics, largely due to the coronavirus pandemic. Large companies including J. Crew, Hertz, Whiting Petroleum, and Diamond Offshore Drilling are facing serious economic issues, plunging into debt and m...aking bankruptcy court their next action. However, with an influx of large and mega bankruptcy cases, there runs the risk of swamping the court system, making it even more difficult to save small businesses. Typically, after a bankruptcy filing, a restructuring and payment plan is established for these companies to pay off debts in times of crisis. If a plan is not decided or not successful, the company in question will most likely be liquidated and go out of business. This is the fate of small businesses if the courts are overrun with cases from larger companies. Without a reform in the courts, many small businesses will disappear along with their employment opportunities, thereby worsening the most disastrous economic downturn since the Great Depression. Many companies were in economic trouble before the pandemic, relying on the conservation of amassed cash, but this cash storage for many is running low. Many experts are advocating for a system reform for the time being, such as extending the period during which companies can come up with payment plans and increasing budgets to rehire retired judges and clerks. Big Bankruptcies Sweep the U.S. in Fastest Pace Since May 2009 In the last month, 27 companies reporting at least $50 million in liabilities sought court protection from creditors, adding to the list of similar companies who have been nearing bankruptcy this year. The May numbers increase the total number of companies of this type to file for bankruptcy to 98 this year. In May of 2009, 29 major companies filed for bankruptcy in May, combining with the 142 major companies with...in the first four months. The numbers now are the highest since these 2009 statistics, and many experts predict that they will not decrease in the foreseeable future. The influx of bankruptcy filings shows a contrast from the U.S. credit markets, where large corporations have been able to borrow money at the fastest pace on record (over $1 trillion in the first five months of the year). However, for weaker companies, the current state of the economy has eliminated their revenues and pushed them into debt, forcing them to seek help in bankruptcy court.
