One of Trump’s outgoing actions was to announce a Venezuelan DED (Deferred Enforcement Departure). It defers deportation of Venezuelans for 18 months and allows them to apply for an EAD (Employment Authorization Document - a work permit.) Obviously, this plays to his base as Venezuelans tend to vote Republican (the other group of Republican Latinos being Cubans), and he should have done something about this a long time ago, nevertheless, it’s a good thing. Because of the cha...nge in administration, the Venezuelan DED memorandum is not currently available on the Whitehouse website, but here is a link: https://www.aila.org/File/DownloadEmbeddedFile/87627. How or when this will be implemented is not clear. Liberian DED (Issued in 2007 and extended through 2021) required a specialized category in the work permit application (I-765) so filing now without an available category could be a waste of time and money. DED authorizations must be published in the Federal Register as a Notice, which hasn’t happened yet. In addition, all of Trump’s orders issued in the last week are paused, although this announcement wasn’t an order, just a memorandum, so it might still be viable. However, Biden may be considering TPS for displaced Venezuelans, which would be a much better option and could lead to LPR (Legal Permanent Resident - green card) status. Stay tuned!
