Effective immediately, a new Section 213-d was added to the CPLR (Civil Practice Law and Rules). There are two notable changes, which greatly impact when we can... file suit. " 213-d. Actions to be commenced within three years; medical debt. An action on a medical debt by a hospital licensed under article twenty-eight of the public health law or a health care professional authorized under title eight of the education law shall be commenced within three years of treatment." This is effectively immediately for new filings. I have not yet seen anything that applies this retroactively to cases already filed. How does this impact us? First, this shortens the Statute of Limitations from previously six years, to now, THREE YEARS. Second, this sets the time to start running from the DATE OF TREATMENT. No longer can we count the time based on the last invoice mailing, the date the insurance carrier made the payment, or otherwise. As such, if you have any outstanding medical debts of any kind, do not delay in sending them to us. Unfortunately, if you had a debt incurred four years ago, it is now time-barred. The Governor of New York has currently suspended the expiration of the Statute of Limitations, during the COVID-19 pandemic. However, if you send us the cases now, we can perform our pre-suit investigation, send requisite notices, and request costs, so will be able to prepare them for suit once the Courts re-open for new filings.
