Effective as of 9:00 PM on March 18, 2020 the United States Tax Court building is closed. Under the holding in Guralnik v. Comm'r, this should extend the time for filing a petition until the date the clerk's office reopens. However, as they have done in the past, the IRS may still move to dismiss petitions based on alleged late filing.

Breaking news! Treasury Secretary Steven Mnuchin announced that his department is pushing back the April 15 tax filing deadline, giving individuals and many businesses 90 extra days to pay taxes they owe. Individuals can defer up to $1 million of tax liability and corporations get an extension on up to $10 million.

Unfortunately, as of now, I do not see any meaningful relief being given by either the IRS or NYS to taxpayers affected by COVID19, especially small businesses. Restaurants, pubs, gyms, and movie theaters in NYS are being ordered to close by government fiat (restaurants can still offer take-out). How are these business supposed to make timely payroll and sales tax payments? How are these businesses supposed to honor their installment payment agreements? Without meaningful relief, when many small businesses close their doors later today, it will be permanent.
