An injured worker may be entitled to monetary benefits for prior lost wages, future lost wages or possible permanent disability. Additionally, an injured worker may be entitled to medical care for injured sites and medical conditions related to the workers' compensation claim. If the need for treatment is deemed causally related to the accident/occupational condition and, when appropriate, consistent with the New York State Workers' Compensation Board Medical Treatment Guidel...ines, treatment is authorized. The Workers' Compensation Law does not allow for additional benefits for "pain and suffering." Insurance companies reward their attorneys for minimizing the cost of their workers' compensation claims. Unfortunately, this reality is the cold hard truth. Many individuals think they can successfully negotiate with the insurance company. Hiring a workers' compensation attorney like Dan or Michael Wugman is the wisest move you can make to maximize the benefits you receive from worker's comp. Attorneys receive payment only on the additional monies you receive above what you would have obtained on your own. The average person does not know the fine points of workers' compensation law, nor do they know what insurance companies should provide. Individual who represents themselves, often receive less than they deserve. You have nothing to lose by hiring an attorney like Wugman & Wugman, P.C. and everything to gain.

Social Security Disability is a government program that pays monthly benefits to workers who are no longer able to work due to a significant illness or impairment that is expected to last at least a year or to result in death within a year. Benefits are based on the disabled worker’s past earnings and are paid to the disabled worker and to his or her dependent family members. To be eligible, a disabled worker must have the proper work credits, or in other words, the worker must have worked in jobs covered by Social Security. To find out if you qualify for benefits and what kind of benefits you might qualify for, visit our website at www.wugmanlaw.com or give us a call for a free consultation.

What is Workers' Compensation? Workers’ compensation is a type of insurance that provides monetary benefits and/or medical care for workers who are injured or become ill as a direct result of their job. Generally, the claim is paid if the employer or insurance carrier agrees that the injury or illness is work-related. If the employer or insurance carrier disputes or denies the claim, no monetary benefits are paid until a determination is made by the Workers’ Compensation Law ...Judge or the Workers’ Compensation Board. If a workers’ compensation claim is denied, the injured worker may be eligible for disability benefits while the claim is being litigated. If the workers compensation claim is eventually established, any payments made by the disability benefits carrier will be subtracted from future workers’ compensation awards. If you can return to work, but your injury prevents you from earning the same wages you earned at the time of the accident, you may be entitled to reduced earnings benefits that will make up two-thirds of the difference. As a result, returning to work at lesser pay is an option. It is also possible, depending upon the employer, to return to work in light or alternate duty but at full pay before you are fully healed. Subject: Stop the Destruction of New York State Workers' Comp as proposed in the 2016 Executive Budget Hi, I signed a petition to The New York State House and The New York State Senate which says:... "New York's injured workers are already suffering. New York State Senate and Assembly must stand with ALL workers and oppose proposals in the NYS 2016 Executive Budget that if passed, will slash worker protections and restrict due process in the Workers' Comp System. " Will you sign this petition? Click here: http://petitions.moveon.org/sign/stop-the-destruction-3 Thanks!
